1. Introduction and Acceptance
Welcome to Mixwell. These Terms of Service ("Terms") govern your use of the Mixwell website and AI recipe generation service (the "Service"). Mixwell is operated by Mixwell team ("we", "our", "us").
By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Service. You confirm that you are legally able to enter into binding contracts in your jurisdiction.
2. Eligibility
You must be at least 13 years old to use Mixwell. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials, providing accurate and current information during registration, and all activities that occur under your account. You must notify us immediately if you suspect unauthorized access to your account by contacting support@mixwell.app.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive activity.
4. Description of Service
Mixwell provides an AI-powered recipe generation service that allows you to generate cooking recipes based on available ingredients using artificial intelligence, upload ingredient photos for automatic recognition, generate recipe images using AI, and save, organize, and share recipes with other users.
The Service uses OpenAI's GPT-5-mini model for recipe text generation and ingredient recognition, and gpt-image-1 model for image generation.
5. Subscription Plans and Usage Limits
We offer Free, Basic, and Pro subscription plans with different monthly limits for recipe generation, image generation, and photo analysis. Usage limits reset monthly on the same calendar day you created your first recipe. Currently, all plans are free. Payment processing will be added in the future. If you exceed your plan limits, you will not be able to generate new recipes or images until the next billing cycle.
6. Content Ownership and Licenses
Your Content: You retain ownership of all recipes, ingredient lists, and photos you create or upload ("User Content"). By uploading User Content, you grant Mixwell a worldwide, non-exclusive, royalty-free license to use, store, and display your content as necessary to provide the Service.
AI-Generated Content: Recipes and images generated by AI models are considered User Content and belong to you. You may use them for personal or commercial purposes. However, AI-generated recipes may contain errors, unsafe cooking instructions, or inaccurate nutrition information. You are solely responsible for verifying the safety and accuracy of AI-generated content before use.
Public Recipes: If you mark a recipe as "Public", it will be visible to all users in the recipe catalog and search results. By making a recipe public, you grant other users a non-exclusive, royalty-free license to view and use the recipe for personal, non-commercial purposes.
7. Acceptable Use Policy
You agree not to use Mixwell for illegal activities or content that violates any laws or regulations, uploading harmful, offensive, or inappropriate images or text, attempting to reverse-engineer, hack, or exploit the Service, creating multiple accounts to bypass usage limits, scraping, crawling, or automated data collection without permission, or impersonating others or providing false information.
Violation of this policy may result in immediate account suspension or termination without notice.
8. Disclaimers and Limitations
No Medical or Nutritional Advice: Mixwell does not provide medical, dietary, or nutritional advice. AI-generated recipes are for informational and entertainment purposes only. Always consult a qualified healthcare professional before making dietary changes, especially if you have allergies, medical conditions, or special dietary needs.
No Guarantee of Accuracy: AI-generated recipes may contain errors and inaccurate measurements, unsafe cooking techniques, or incorrect nutrition information. You are solely responsible for verifying the safety and accuracy of recipes before use.
Service Availability: We strive for reliable service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We are not liable for any damages resulting from service interruptions.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIXWELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, FOOD POISONING, ALLERGIC REACTIONS, OR HEALTH ISSUES RESULTING FROM FOLLOWING AI-GENERATED RECIPES, OR DAMAGES FROM SERVICE INTERRUPTIONS, ERRORS, OR DATA LOSS.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICH IS CURRENTLY ZERO DOLLARS FOR FREE PLANS.
10. Intellectual Property
The Mixwell brand, logo, website design, and software code are owned by Mixwell and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
11. Termination
You may delete your account at any time from your profile settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy, and your recipes will become anonymous.
We may suspend or terminate your account immediately without notice if you violate these Terms or our Acceptable Use Policy, we suspect fraudulent activity or abuse, or if required by law or legal process.
Upon termination, your right to use the Service ends immediately. Any data retention will follow our Privacy Policy.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or by posting a prominent notice on the website. Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the Service.
13. Governing Law and Dispute Resolution
For users outside Russia, these Terms are governed by international commercial law principles. Disputes will be resolved through good-faith negotiation. For users in the European Union, you have the right to file complaints with your local data protection authority under GDPR.
For users in the Russian Federation, these Terms are governed by the laws of the Russian Federation. Any disputes will be resolved in accordance with Russian civil law. You have the right to file complaints with Roskomnadzor (Federal Service for Supervision of Communications, Information Technology and Mass Media) regarding personal data processing.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
